When Police Can Arrest or Search You Without A Warrant

A plain guide to the narrow cases where a warrantless arrest or search is legal in the Philippines, and what to do if you are stopped.

A checkpoint stops your car late at night. An officer asks you to step out and open your bag. Or two men in plain clothes walk up to you, say they got a tip, and start patting you down. Can they do that? Sometimes yes, more often no. The line is narrower than most people think, and knowing it protects you.

Start with the Constitution. Article III, Section 2 of the 1987 Constitution says you are secure in your person, house, papers, and effects against unreasonable searches and seizures. As a rule, an arrest or a search needs a warrant issued by a judge who personally found probable cause. And anything seized in violation of that rule cannot be used against you in any proceeding. That is the exclusionary rule in Article III, Section 3(2).

The warrant requirement does have exceptions. But they are short lists, and the courts read them strictly.

When an arrest without a warrant is legal

Rule 113, Section 5 of the Revised Rules of Criminal Procedure allows a warrantless arrest in only three situations:

- In flagrante delicto: you are committing, attempting to commit, or have just committed a crime in the officer's presence.
- Hot pursuit: an offense has just been committed, and the officer has probable cause based on personal knowledge of facts that you did it.
- Escapee: you escaped from prison or from custody while your case was pending.

A tip or an anonymous call, standing alone, is not enough. The officer has to personally see or know the facts. A private person can also make a citizen's arrest on the same three grounds, and must then turn the person over to the nearest police station right away.

When a search without a warrant is legal

Over the years the Supreme Court has recognized a limited set of searches that do not need a warrant. The main ones are: a search made as an incident to a lawful arrest (Rule 126, Section 13), a search of a moving vehicle, seizure of items in plain view, a stop and frisk for weapons, a search at a valid checkpoint (limited to a visual once-over), a customs or border search, and a search you freely and knowingly consented to.

Watch the order in one of these. For a search incident to a lawful arrest, the arrest must come first. Police cannot search you, find something, and only then call it an arrest. The process cannot be reversed.

What the courts keep throwing out

Two cases show how strict the rule really is.

In People v. Cogaed (G.R. No. 200334, 30 July 2014), the Supreme Court acquitted the accused because the police frisked him based only on another person's signal, not their own observation. A stop and frisk needs a genuine reason that the officer personally observed, not a hunch borrowed from someone else.

In Veridiano v. People (G.R. No. 200370, 7 June 2017), officers searched a passenger on a jeepney because of a tip that he was carrying drugs. The Court threw out the evidence: a tip is hearsay, and a moving-vehicle search still needs probable cause. The accused was acquitted.
