How to file a complaint against a public official

The permit that moves only "for merienda"

You bring the complete requirements. Everything's in order. Then the person across the counter slides your folder aside and mentions, almost kindly, that things move faster with a little something for the staff. Or the clearance you need this week keeps turning into "follow up na lang bukas." Or an enforcer flags you down and hints that this can be settled quietly.

That's not just rude. It can be graft, and the law gives you a place to take it. Article XI, Section 1 of the 1987 Constitution says it in seven words: public office is a public trust. The office built to guard that trust is the Office of the Ombudsman.

What the Ombudsman is for

The Ombudsman is the government's own watchdog over public officers. Under Article XI, Section 12 of the Constitution, the Ombudsman and its deputies act as protectors of the people and must act promptly on complaints filed "in any form or manner" against government officials and employees. Republic Act No. 6770 (The Ombudsman Act of 1989) builds out that mandate. The office can pursue two kinds of liability at once: administrative, such as suspension or dismissal, and criminal, such as graft charges in court.

The conduct it goes after is listed in Republic Act No. 3019 (Anti-Graft and Corrupt Practices Act). Section 3 makes it unlawful for an official to ask for or accept a gift in exchange for a permit or license, to cause you undue injury or hand someone an unwarranted advantage, or to sit on a paper you are entitled to in order to squeeze something out of you. Asking for "pang-merienda" to release a document you already deserve is not a grey area. Republic Act No. 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees) adds the plain duty to act on the public's requests on time and bars officials from soliciting gifts.

Red tape or graft? Often both

Not every bad counter experience is graft. Sometimes it is plain red tape, and a separate law aims squarely at that: Republic Act No. 9485, as amended by Republic Act No. 11032 (the Ease of Doing Business and Efficient Government Service Delivery Act of 2018). It gives you footing. Every agency must post a Citizen's Charter listing its requirements, fees, and the maximum time to act, as a rule three working days for simple requests, seven for complex ones, and twenty for highly technical ones. Miss that deadline with your papers and fees complete, and the request can be deemed approved. Fixing is illegal, and every office must keep a complaints desk.

The two laws meet at the counter. A delay that comes with a quiet ask for money is red tape and graft at the same time. You can raise the red tape with the Anti-Red Tape Authority (ARTA) or the Civil Service Commission, and the heavier cases go further: the law places administrative jurisdiction over these violations with either the CSC or the Ombudsman, and a finding under it does not bar a separate graft case (RA 11032, Sections 23 and 24).
