Bail: when it is your right and when the judge decides

A plain guide to bail in the Philippines: when release is a matter of right, when it is up to the judge, how the amount is set, and what to do if you cannot pay.

The call usually comes late. A brother, a driver, a neighbor's son has been picked up and is now at the police station. The first questions out of everyone's mouth are the same: magkano ang piyansa, and can he come home tonight?

Bail is the answer to that second question, and it is not as mysterious as it sounds. Under Rule 114 of the Revised Rules of Criminal Procedure, bail is simply the security you give so a person in custody can be released while the case runs, on the promise that he will show up in court whenever required. It is not a fine and it is not an admission of guilt. It exists because a person is presumed innocent until proven otherwise, and should not sit in jail before that is decided.

The four ways to post it

Bail can take four forms: a corporate surety (the bonding companies you see near the courts), a property bond (real estate put up as security), a cash deposit, or recognizance (release to the custody of a responsible person, no money paid). The court fixes the amount and the accused, or anyone acting for him, arranges it.

When bail is your right

For most offenses, bail is a matter of right, not a favor. The 1987 Constitution, Article III, Section 13, and Rule 114, Section 4, say a person shall be admitted to bail before or after conviction by the first-level courts (the Metropolitan, Municipal, and Municipal Circuit Trial Courts), and before conviction by the Regional Trial Court, as long as the offense is not punishable by death, reclusion perpetua, or life imprisonment. The right holds even if the privilege of the writ of habeas corpus is suspended, and the Constitution flatly bars excessive bail.

When it is up to the judge, or not allowed

The picture changes for the most serious charges. Under Rule 114, Section 7, a person charged with a capital offense or one punishable by reclusion perpetua or life imprisonment cannot be bailed when the evidence of guilt is strong, at any stage of the case. Whether the evidence is strong is not assumed. The prosecution has to prove it at a bail hearing, and the court must actually hold that hearing (Sections 8 and 18). If the evidence falls short, bail can still be granted.

After the Regional Trial Court convicts someone of a bailable offense, bail turns discretionary (Section 5). If the penalty imposed is more than six years and there are red flags, such as being a repeat offender or a flight risk, the court can deny or cancel bail.

## How the amount is set

Judges do not pull a number from the air. Rule 114, Section 9, lists what they weigh: your financial ability, the nature of the offense, the penalty, your character and reputation, the strength of the evidence, and the likelihood you will actually appear. Excessive bail is not allowed, and if the figure is beyond reach you can ask the court to reduce it (Section 20).

## If you truly cannot pay

Poverty is not supposed to be the reason someone stays locked up. Republic Act No. 10389 (the Recognizance Act of 2012) makes release on recognizance a matter of right for an indigent accused when the offense is not punishable by death, reclusion perpetua, or life imprisonment. It takes a sworn declaration of indigency, a certification from the local social welfare office, arraignment, and notice to the local sanggunian and the prosecutor. Separately, Rule 114, Section 16, says a person already detained for as long as the minimum penalty may be released on reduced bail or on his own recognizance.
